Terms and Conditions for UPSHOT CRM System

1. Introduction

These Terms and Conditions govern your use of the UPSHOT CRM system (“SURESHOT”), which is built on the Go High Level platform. By using SURESHOT, you agree to comply with these terms and conditions. If you do not agree with these terms, you must not use SURESHOT.

2. Pricing & Subscription

• The base price for SURESHOT is $599 per month, which includes 1 Manager seat and 2 Agent seats.
• For any additional seats, you will be charged $100 per month per seat (ExtraSHOT).
• All payments are due on a monthly basis, and you will be billed at the start of each billing cycle. Payments are non-refundable unless specified otherwise in the money-back guarantee section.

3. Money-Back Guarantee

• UPSHOT offers a 3-month money-back guarantee on the $599 base amount only.
• If you are not satisfied with SURESHOT within the first 3 months of your subscription, you may request a refund for the $599 amount only.
• Refund requests must be submitted in writing within 90 days of the initial payment to be eligible for the refund.

4. Use of SURESHOT

• SURESHOT includes over 300 pre-configured emails spread across 12 campaigns and 4 pipelines. These emails are provided to help streamline your processes but are not guaranteed to be error-free.
• Responsibility for Content: You are solely responsible for ensuring the accuracy and appropriateness of the content you use, including email campaigns, within SURESHOT. UPSHOT is not responsible for any mistakes in emails sent using SURESHOT, including errors in grammar, incorrect data, or failure to comply with applicable laws and regulations.
• Any errors found by the client will be remedied once brought to UPSHOT’s attention.

5. Access and Account Management

• Upon payment of the subscription, you will be granted access to SURESHOT, including the designated Manager seat and Agent seats.
• You may upgrade the number of seats at any time, but additional seats will incur an additional charge of $100 per month per seat.
• You are responsible for maintaining the confidentiality of your account and login credentials, and you are fully responsible for all activities that occur under your account.

6. Termination

• You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing cycle.
• UPSHOT reserves the right to suspend or terminate access to SURESHOT if you breach any of these Terms and Conditions, without refund.

7. Limitation of Liability

• UPSHOT will not be held liable for any direct, indirect, incidental, or consequential damages arising from the use of SURESHOT, including but not limited to, lost profits, errors in data processing, or failure to deliver intended results.
• UPSHOT is not responsible for any mistakes in emails, campaigns, or other content produced or distributed using SURESHOT.

8. System Updates and Availability

• UPSHOT may periodically update SURESHOT to improve functionality and performance. Updates will be communicated to you in advance when possible, but UPSHOT is not liable for any disruptions or issues caused by updates.
• SURESHOT may experience occasional downtime due to maintenance or other technical issues. UPSHOT will make reasonable efforts to minimize downtime and restore service as quickly as possible.

9. Governing Law

• These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which UPSHOT is based, without regard to its conflict of law principles.

10. Changes to Terms and Conditions

• UPSHOT reserves the right to amend or update these Terms and Conditions at any time. Any changes will be communicated to you, and your continued use of SURESHOT constitutes acceptance of any changes.
